James Cai

James Cai founded Schein & Cai LLP after serving as in-house legal counsel for Yahoo! Inc.  His immigration practice focuses on advising international business clients that are starting up or expanding their operation in the United States, and foreign nationals filing Eb-5 investment immigrant visa petitions in terms of due diligence review of investment projects and designing the appropriate ownership structure.  He has served as outside general counsel for multi-national corporations to incorporate US subsidiaries, ensure full legal compliance of their human resource practice and petition for L-1 visas for high level executives.


Mr. Cai believes in relationship lawyering and has a client-driven practice. He practices law the old fashioned way – giving each client this full attention with prompt responses, thorough research and analysis, aggressive representation and careful attention to details.  As a result, most of his clients are repeat and long term clients, including individuals, small businesses, non-profit organizations and public companies.


Before founding Schein & Cai LLP, Mr. Cai served as in-house counsel for Yahoo! Inc. He also practiced law with Morrison & Foerster LLP and Gray Cary Ware & Freidenrich LLP (now known as DLA Piper Rudnick Gray Cary), two of the largest law firms in California.  Mr. Cai holds a Juris Doctor, Magna Cum Laude, from Temple University School of Law in Philadelphia, graduating in the top 5% of his class.


Mr. Cai is committed to community services and is frequently invited as a guest speaker and commentator on current legal issues by local news media, non-profit organizations and chambers of commerce.  He is the co-founder and Chairman of Silicon Valley Information Business Alliance (www.sviba.org) and served asa commissioner for Community Development Block Grant Steering Committee for the City of Cupertino.



Jay Terkiana  

Jay Terkiana is the Lead Immigration Attorney of our firm. Mr. Terkiana was Senior Counsel at a prestigious firm in Manhattan, New York, where he handled corporate immigration and related transactional matters. During this time he successfully obtained investment based immigration (Eb-5) for overseas investors, H-1 classifications for difficult cases, including Market Research Analyst, Business Development Specialist, Sales Managers, Accounts Managers, HR Managers, Public Relations Specialist, Publishers, and L-1 classifications for Restaurant Managers, Finance Managers, Functional Managers, and several other challenging positions. Prior to that, Mr. Terkiana worked for reputed Bay Area (California) and Arlington (Washington, D.C.) based law firms and has over the years developed a strong expertise in successfully handling extremely difficult cases, reversing complex denials, compliance consultations, defending government audits and related litigation.

Mr. Terkiana has successfully challenged complex USCIS denials, by filing motion to reopen, reconsider, appeals and nunc pro tunc extensions under 8 C.F.R. § 214.1(c)(4), claiming ineffective assistance of previous counsel under Matter of Lozada, and reversed the denials. He has assisted several international clients in obtaining EB-5 investor classifications under New Business, Troubled Business, Existing Business, and Regional Center Investment designations. Mr. Terkiana has strong niche/expertise in obtaining H-1B visas for small businesses, for challenging positions like Business Development Specialist, Market Research Analyst, Sales Managers, Public Relations Specialist, Marketing positions, Accounting positions, etc.  Where L-1, E-2, and other immigration classifications are becoming increasingly difficult for small, mid-sized and start-up companies, Mr. Terkiana has strong technical expertise to represent such clients in obtaining the desired classifications.
