James Cai founded Schein & Cai LLP after serving as in-house legal counsel for Yahoo! Inc. His immigration practice focuses on advising international business clients that are starting up or expanding their operation in the United States, and foreign nationals filing Eb-5 investment immigrant visa petitions in terms of due diligence review of investment projects and designing the appropriate ownership structure. He has served as outside general counsel for multi-national corporations to incorporate US subsidiaries, ensure full legal compliance of their human resource practice and petition for L-1 visas for high level executives.
Mr. Cai believes in relationship lawyering and has a client-driven practice. He practices law the old fashioned way – giving each client this full attention with prompt responses, thorough research and analysis, aggressive representation and careful attention to details. As a result, most of his clients are repeat and long term clients, including individuals, small businesses, non-profit organizations and public companies.
Before founding Schein & Cai LLP, Mr. Cai served as in-house counsel for Yahoo! Inc. He also practiced law with Morrison & Foerster LLP and Gray Cary Ware & Freidenrich LLP (now known as DLA Piper Rudnick Gray Cary), two of the largest law firms in California. Mr. Cai holds a Juris Doctor, Magna Cum Laude, from Temple University School of Law in Philadelphia, graduating in the top 5% of his class.
Mr. Cai is committed to community services and is frequently invited as a guest speaker and commentator on current legal issues by local news media, non-profit organizations and chambers of commerce. He is the co-founder and Chairman of Silicon Valley Information Business Alliance (www.sviba.org) and served asa commissioner for Community Development Block Grant Steering Committee for the City of Cupertino.
Ms. Love Macione is a Senior Immigration Of Counsel of our firm. She assists our domestic and international clients who need to hire foreign born employees, reunite with their overseas family members or petition for investment based immigration. She has been exclusively practicing immigration law for almost thirteen years and is certified by the California State Bar as a specialist in Immigration and Nationality Law. In order to become a certified specialist, one must not only pass a rigorous examination, but must also demonstrate a high level of experience and knowledge in the field and be favorably evaluated by other attorneys and judges. Specialists are certified by the Immigration & Nationality Law Advisory Commission of the State Bar of California's Board of Legal Specialization. After becoming a certified specialist, Ms. Macione was herself appointed to this Commission, where she currently is serving a three year term. She is also a member of the Pro-Bono Immigration Panel for the Bar Association of San Francisco. She also serves as immigration advisor to various community organizations.
Ms. Macione has a unique litigation background, starting her career as a removal defense and appellate attorney. She has represented hundreds of clients in removal and exclusion proceedings and has filed many successful appeals to the AAO, the BIA, the Ninth Circuit, and U.S. District Courts, some decisions having been published, becoming precedent law. She was the managing attorney at Reeves and Associates in charge of establishing its satellite office in San Francisco. She has excellent analytical, oral and written communication skills, honed not only from years of litigation and appellate practice, but also from the experience she gained working with excellent colleagues.
Ms. Macione also has recent and substantial experience in the successful filing of all manner of employment-based immigrant and non-immigrant visas. Approximately half of her practice is in the area of business immigration. She has represented employers from small businesses to multinational corporations in an array of industries, as well as employees, investors, and entrepreneurs.
She also has experience with less common non-immigrant visas, such as P, Q athletes, artists, cultural exchange visitors. She also has handled hundreds of family-based immigration cases, both within the United States and at consulates across the world, as well as other types of cases such as political asylum, Temporary Protected Status, and visas for witnesses and victims of crimes and human trafficking.
Because of Ms. Macione's litigation background and wide range of experience dealing with various branches of the government (USCIS, ICE, State Department, immigration courts, administrative tribunals, and federal district and appellate courts) she is very knowledgeable about the importance of the filings complying with the statute, the regulations, as well as agency and court interpretations of same.
Ms. Macione graduated from San Francisco State University with a Bachelor of Arts degree in Anthropology/Urban Studies (Magna Cum Laude) and obtained her Juris Doctor degree from the University of California, Hastings College of the Law. As a law student she studied comparative constitutional law at Touro University in Shimla, India. She also speaks Spanish.
